Hi all,

I am moving out of my rented house soon and so have given notice to my letting agent and landlord.

Does anyone know whether I am within my rights to demand that viewings are only carried out whilst either me or my partner are in attendance? We both work full time so this would mean only evening and weekend viewings...

You're within your right to refuse all entries. You're entitled to "quiet enjoyment" by law no matter what the contract says.

It does say in the tenancy that we have to give the Landlord or the Landlords agent access provided we recieve 24 hours notice...

I don't mind them doing viewings provided I am in at the time - I understand that the landlord needs to relet the place.

The reason I want to be in is that I have a house cat and the other half doesnt want it getting stressed out, also we have lots of gadgety type stuff that I wouldnt want going missing (ipod, phone, laptops, psp etc) - all on charge about the house most of the time.

The law states as mentioned by Anorthosite that you are entitled to your quiet enjoyment of a rented property. As this is law no contract will supercede it contrary to what a lot of LA\LL would have you believe and the same applies to quarterly management inspections!

What your contract refers to regarding 24hour notice and access to property is that in the case of the LL or their agent needing to carry out a repair then they have to give you 24hr notice before entering the house regardless of whether you like it or not. Again this is law but its only so any repairs that the LL needs to carry out as part of their duties of being a LL can be fufilled.

If you want to forgo your right to quiet enjoyment then thats up to you but you wouldnt be unreasonable in asking to be present whenever a viewing takes place.

Many Amateur Landlords think they have the right to come and go in the property they rent out but its not the case, the law is fully behind you and your right to quiet enjoyment of property. Besides some other clauses in a rental agreement maybe void anyway under the 1999 unfair consumer contracts act.
